Terms of Service

1. Overview
These Terms of Service (“Terms”) govern your access to and use of QARIN, including our website, dashboards, integrations and AI assistants (collectively, the “Service”). By using the Service, you agree to be bound by these Terms.
If you are using QARIN on behalf of a business, you represent that you have authority to bind that business to these Terms. In that case, “you” and “your” refer to the business.
2. Eligibility & accounts
- You must be able to form a legally binding contract to use QARIN for your business.
- You are responsible for maintaining the confidentiality of any login details and API keys.
- You are responsible for all activity that occurs under your account.
3. Use of the Service
You agree to use QARIN only for lawful purposes and in accordance with these Terms. You will not:
- Use QARIN to violate any laws, infringe rights, or mislead customers;
- Attempt to interfere with the security or integrity of the Service;
- Reverse engineer, decompile or attempt to derive the source code of the Service;
- Use QARIN to build or train a competing product.
You are responsible for the content you feed into QARIN and for ensuring that your use complies with any policies (for example, platform terms of Shopify, Stripe, or email providers).
4. Integration & access to your website
To deploy QARIN on your site or store, we may need technical access to your environment. This can include (but is not limited to):
- Adding or editing a JavaScript snippet, app, or theme file;
- Creating or configuring API keys, webhooks or private apps;
- Defining events (e.g. page views, add-to-cart, checkout) to measure performance.
You authorise us and our integration partners to perform these actions for the purposes of configuring and maintaining QARIN, within the scope agreed with you.
Once integration is complete, we do not continue to access or modify your website code or admin environment except:
- Where you explicitly request ongoing management or changes; or
- Where access is required for troubleshooting, security or compliance reasons.
5. Data & privacy
Our handling of personal data is described in our Privacy Policy. In summary:
- We ingest content you provide (e.g. product data, FAQs, policies) to power your instance of QARIN.
- We may process chat transcripts, events and analytics to operate and improve the Service.
- We generally do not retain technical access to your site after integration is complete, unless requested.
- We do not sell your data or use your customers’ data to train a generic model for other clients.
You are responsible for providing any notices and obtaining any consents from your customers required under applicable laws when you deploy QARIN on your properties.
6. Plans, fees & billing
- Pricing, seat limits and usage limits are described on our Pricing page or in a written order.
- By subscribing to a paid plan, you authorise us (or our payment processor, such as Stripe) to charge your payment method for the applicable fees.
- Unless otherwise stated, subscriptions renew automatically at the end of each billing period.
- You are responsible for any applicable taxes.
- We may change prices or plan features on renewal; if we do, we will aim to notify you in advance.
If a payment fails and is not corrected within a reasonable period, we may suspend or limit access to QARIN.
7. Intellectual property
We own all rights, title and interest in and to QARIN, including the software, models, dashboards and documentation (excluding your content). These are protected by copyright and other laws.
You retain all rights to your content, including your product data, brand assets, FAQs and policies. By using QARIN, you grant us a limited, non-exclusive licence to use that content solely to provide the Service to you.
You may not remove, alter or obscure any proprietary notices on the Service.
8. Disclaimers & limitation of liability
The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including fitness for a particular purpose and non-infringement.
AI systems can make mistakes. You are responsible for reviewing and configuring QARIN (including guardrails, policies and escalation paths) to ensure responses are appropriate for your use case.
To the extent permitted by law, our total liability arising out of or relating to the Service is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the claim. We are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or revenues.
9. Suspension & termination
- You may stop using QARIN at any time. Some plans may auto-renew until cancelled.
- We may suspend or terminate access if you materially breach these Terms or misuse the Service.
- Upon termination, your right to use QARIN ceases. We may retain certain records as required by law.
10. General
We may update these Terms from time to time. If we make changes, we will post the updated Terms on this page and update the “Last updated” date. Continued use of QARIN after changes take effect constitutes acceptance of the new Terms.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force.
